- Obtained Rule 12(b)(6) dismissal of the plaintiff’s claims for negligence, malpractice, fraud, breach of contract, defamation, and conspiracy against healthcare client, which was affirmed by the Kentucky Court of Appeals.
- Obtained summary judgment and dismissal of the plaintiff’s claims for negligence against hotel client.
- Obtained summary judgment and dismissal of the plaintiff’s negligence claims pursuant to up-the-ladder immunity under the Kentucky Workers’ Compensation Act in action against national retailor client.
- Obtained summary judgment and dismissal of the plaintiff’s product-liability claims for defective design and defective manufacture in action against manufacturing client.
- Obtained summary judgment and dismissal of the plaintiff’s product-liability claims for negligence and dismissal of a co-defendant’s claims for indemnity and contribution in action against industrial client.
- Obtained summary judgment and dismissal of trespass, temporary nuisance, negligence, negligence per se, civil conspiracy, battery, and product-liability claims in action against agricultural client.
- Obtained decertification of previously-certified class action, leading to highly favorable settlement of claims against agricultural client.
- Obtained initial dismissal of class-action allegations against multi-national insurance carrier client.
- Negotiated and managed class-action settlement in action against multi-national insurance carrier client involving more than 160,000 class members and over $4m in settlement awards.
- Obtained summary judgment and dismissal of a defendant’s third-party claims for indemnity in wrongful-death action against transportation industry client.
